How
How to apply for an Artist Home Page?
Submit the following materials:
1. Personal Information: Provide
your personal information including, your
name, address, phone number and e-mail (if applied). This
information is
very important for us to contact you especially when there are
potential buyers
interested in your works.
2. Biography: stating your background, education, experience, honor
and etc.
3. Art Works: choose 6 to 10 pieces of your best art works
4. Description of Art Works: give description to each of your
selected art
works such as, title, medium, size, year created and price (if you wish
to sell)
5. Option: you may choose to enclose a price list to us if:
(a) you wish to sell your art works through 123soho.com web site; and
(b) you agree with our 25% commission fee when your art works are sold.
Otherwise, mention "Not For Sale" in your forwarding materials if you choose not
to sell the art works through us.
Sumbit your materials by e-mail or regular mail:
Option 1. Sent by e-mail
(123soho.com prefer this option the most!)
1. Your personal information, biography and art work descriptions need to be text
file (i.e. "filename.txt")
2. Images need to be jpeg file or gif file (i.e. "filename.jpg" or
"filename.gif")
3. E-mail them all to "info@123soho.com",
subject: "Apply Artist Home Page"
Option 2. Sent by regular mail
1. Type your personal information, biography and art work descriptions on paper
(maximum two 8.5" x 11" pages)
2. Art work images can be photograph, slide, or transparency
(no larger than 8" x 10")
3. Enclose a stamped self-address envelope for returning submitted materials. No
materials will be returned if the stamped self-address envelope is not
provided.
4. Mail to 123soho.com, inc., 490 Greenwich Street, New York, NY 10013, U.S.A.
Note: Be advised that once images of your art
works are posted on site, no deletion is allowed.

What terms I have to agree?
1. YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the Service, you agree
to:
(a) Provide true, accurate, current and complete
information about yourself as promoted by the Service's registration form (such
information being the "Registration Data") and
(b) Maintain and promptly update the Registration Data to
keep it true, accurate, current and complete.
(c) Allow 123soho keeping every of your posted images and related information on
site without any deletion, except duplicated images can be deleted and removed from
123soho.com web site.
If you provide any information that is untrue, inaccurate, not current or incomplete, or
123soho has reasonable grounds to suspect that such information is untrue, inaccurate, not
current or incomplete, 123soho has the right to suspend or terminate your registration and
refuse any and all current or future use of the Service (or any portion thereof).
2. AUTHORIZE RIGHTS TO DISPLAY, SELL AND REPRODUCE
You certify that you own all rights, including
copyrights of all submitting materials provided to 123soho. In accordance with
this Agreement, you authorize 123soho:
(a) the right to display images of your art works and related information,
(b) the right to sell your art works (only if you wish to sell), and
(c) the right to reproduce your art works (only if you choose to sell a reproduction of
your original art works).
3. MEMBER'S PERSONAL PAGE, PASSWORD AND SECURITY
(For Members under 123soho
"Members" category Only)
You will receive a password and personal page upon
completing the Service's registration process. You are responsible for maintaining
the confidentiality of the password and are fully responsible for all activities
that occur under your password or personal page. 123soho cannot and will not be
liable for any loss or damage arising from your failure to comply with this section.
4. COPYRIGHT
123soho dose not claim the ownership of Content you
submit. However, due to the internet capability of public accessibility, there might
be a possibility on individuals to download, reproduce, modify and distribute your
on site Content. It is considered to be at your own risk. In fact, by
browsing, visiting, or accessing this site, each individual must agree to abide by
"123soho Website Legal Terms and Conditions". It clearly states that any
use of materials on this web site, including reproduction, modification, distribution, or
republication, without the prior written permission of 123soho is strictly prohibited. ALL
RIGHTS RESERVED.
5. PAYMENT OF ROYALTY
For Individual Artists who wish to sell art works
through 123soho
When sales occur, 123soho takes a commission fee 25% off the total sale amount which is
collected from buyers. Then, 123soho will pay the rest 75% to artists. With
each royalty payment, 123soho will provide artists a receipt with sets forth the
calculation of the amount of the royalty payment.
For Galleries, Art Organizations and Others who wish
to sell art works through 123soho
A suggested and desirable commission rate must be made and agreed between 123soho and
galleries, art organizations or any parties before sales should proceed. 123soho
takes the commission rate off the total sale amount which is collected from buyers.
Then, 123soho will pay the balance to galleries, art organizations or correspondence
parities. With each royalty payment, 123soho will provide galleries, art
organizations or correspondence parities a receipt with sets forth the calculation of the
amount of the royalty payment.
6. AMENDMENT
123soho reserves the right at any time and from time to
time to modify, amend or discontinue, temporarily or permanently, the Service (or any part
thereof) with or without notice. You agree that 123soho shall not be liable to you
for any modification, suspension or discontinuance of the Service.
7. TERMINATION
You agree that 123soho, in its sole discretion, may
terminate your use of the Service, and remove and discard any Content within the Service,
for any reason, including, without limitation, for lack of use or if 123soho believes that
you have violated or acted inconsistently with our terms and agreement. 123soho may
also in its sole discretion and at any time discontinue providing the Service, or any part
thereof, with or without notice. You agree that any termination of your access to
the Service under any provision of the Agreement may be effected without prior notice, and
acknowledge and agree that 123soho may immediately deactivate or delete your personal page
and all related information or the Service. Further, you agree that 123soho shall
not be liable to you for any termination of your access to the Service.
On the other hand, 123soho agrees that you, in your sole
discretion, may write to terminate your 123soho service by providing 30 days written
notice when you are not satisfaction with 123soho service.
8. FOR INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree
to comply with all local rules regarding online conduct and acceptable Content.
Specifically, you agree to comply with all applicable laws regarding the transmission of
technical data exported from the United States or the country in which you reside.
9. APPLICABLE LAW
This Agreement shall be governed by the laws of the
State of New York.
